IMPORTANT: THESE TERMS OF USE INCLUDE AN AGREEMENT TO RESOLVE DISPUTES WITHOUT RESORT TO CLASS ACTION LITIGATION, OTHER REPRESENTATIVE ACTIONS, OR A JURY TRIAL, AS STATED IN THE 'RESOLUTION OF DISPUTES' PROVISION. PLEASE READ THESE TERMS OF USE CAREFULLY. THESE TERMS OF USE CONSTITUTE A LEGALLY BINDING AGREEMENT BETWEEN YOU AND PACSUN THAT CONDITIONS YOUR USE OF THE SERVICES. BY USING, PARTICIPATING IN, OR ACCESSING PACSUN SERVICES (AS DEFINED BELOW), YOU SIGNIFY YOUR ACCEPTANCE OF THESE TERMS OF USE. IF YOU DO NOT AGREE TO THESE TERMS OF USE, YOU SHOULD NOT ACCESS OR USE THE SERVICES.

DELIVERY AND ACCEPTANCE

Once the order has been placed, Majid Al Futtaim will provide you with an estimated date of delivery. You can also call Customer Service to request a delivery schedule that suits you. Majid Al Futtaim will strive to deliver your order on or near the estimated date provided. Please note that this date is just an estimate and is subject to change. Majid Al Futtaim reserves the right to cancel delivery, change the delivery fee (if applicable), and reschedule delivery date. In such cases, our delivery agent will call to inform you of any cancellations/changes. Please note that Majid Al Futtaim is not liable for any damage to or loss of your goods.

For further details, you can consult an associate via customercare@pacsun.me. Upon receipt of goods, you or a nominated person are requested to inspect and sign the delivery documents to acknowledge the condition of the goods and the complete delivery of all Items.

MANUFACTURING DEFECTS

Any manufacturing faults must be notified to Majid Al Futtaim within 7 days of receipt of goods.

EXCHANGES / RETURNS

For online purchases, all return and exchange periods apply from the date of delivery. For in-store purchases, the policy applies from the date of purchase.

• Full-priced items can be refunded or exchanged within 30 days from the date of delivery.
• Sale items can be refunded or exchanged within 14 days from the date of delivery.
• A 7-day exchange or refund will be provided in the case of a manufacturing defect.

To be eligible for a return or exchange:

• Items must be unused, unaltered, and in good condition.
• Items must be unworn, with original tags attached and in their original condition.
• Items must be returned in their original condition, tags attached, and unworn.
• Footwear must be returned with their original shoebox.
• Please retain your purchase receipt and include the original order confirmation.
• Authenticity/Warranty cards, where provided, must also be returned.
• Exchanges can be done for equal or higher amounts.

No refunds, returns or exchanges will be permitted for the below items:

• Swimwear, accessories, lingerie, underwear and earrings for hygiene and sanitary purposes.
• Returns and exchanges will be processed only in the country of purchase and in the original payment mode. Refund period will depend on the bank to which the funds are being returned to.

PAYMENT AND REFUNDS

Majid Al Futtaim accepts payment by credit and debit cards. All refunds — both for UAE and non-UAE deliveries — will be accomplished by reverting to the same original payment form.

OWNERSHIP AND RISK

Once payment has been received in full, the ownership of all goods will pass to you. Risk of loss, damage, or deterioration is transferred to you upon acceptance of delivery.

LIABILITY

Majid Al Futtaim shall only be liable for direct damages or losses caused to you due to a breach of any of Pacsun's obligations. For clarity, Majid Al Futtaim shall not be responsible for any lost profits, reputation damages, consequential losses, or any other type of costs, expenses, or losses.

PROMOTIONAL CODES, DISCOUNT SCHEMES AND OFFERS

Promotional codes are valid only in accordance with their terms until the date stated therein, can be used only once, are not redeemable for cash and cannot be used in conjunction with any other offer, sale or promotion. They are personal to you and cannot be transferred to third parties.

SALES RESPONSIBILITY

Pacsun is not responsible for sales made through the Website. The seller on record for these purchases is Majid al Futtaim Lifestyle (MAFL).

Any issues or disputes related to sales made through the Website should be directed to MAFL.

THIRD-PARTY BENEFICIARY

Pacsun is considered a third-party beneficiary in relation to the transactions and agreements made through the Website. Pacsun retains certain rights and benefits arising from these transactions as stipulated by its agreement with MAFL.

LIMITED RIGHTS TO PACSUN

Majid Al Futtaim Lifestyle holds only the rights to use Pacsun in specific regions as specified in their agreement. Majid Al Futtaim Lifestyle does not possess any additional rights to Pacsun, nor can they provide licensing for Pacsun products or intellectual property beyond the scope of their agreement.

LEGAL EFFECT

If any part of these Terms and Conditions is declared illegal or becomes unenforceable, the remaining terms will not be affected and will continue to be in force.

These Terms and Conditions shall be ruled and governed by the laws of Dubai and the federal laws of the UAE. Unless agreed otherwise in writing by Pacsun and you, these Terms and Conditions precede over any other terms and conditions.
